California Minimum Wage
As of January 1, 2024, California's statewide minimum wage is $16.00 per hour for all employers, regardless of size. However, many cities and counties within California have their own local minimum wage ordinances that are higher than the state rate. Overtime Rules in California (1.5x Rate)
California law mandates overtime pay at 1.5 times an employee's regular rate of pay for the following:
- Daily Overtime: All hours worked over eight (8) hours in any workday.
- Weekly Overtime: All hours worked over forty (40) hours in any workweek.
- Seventh Consecutive Day: The first eight (8) hours worked on the seventh consecutive day of work in a workweek.
It's important to note that daily and weekly overtime are not "stacked." If an hour qualifies for daily overtime, it is paid at 1.5x and does not also count towards weekly overtime for the purpose of calculating additional 1.5x pay.
Double Overtime Rules in California (2x Rate)
California law also requires double the employee's regular rate of pay for:
- Daily Double Overtime: All hours worked over twelve (12) hours in any workday.
- Seventh Consecutive Day Double Overtime: All hours worked over eight (8) hours on the seventh consecutive day of work in a workweek.
